RIGHT OF WITHDRAWAL, LEGAL GUARANTEE OF CONFORMITY AND SELLER'S WARRANTY
Right of withdrawal
Pursuant to Articles 52 et seq. of the Italian Consumer Code (Legislative Decree 206/2005), the Customer qualifying as a Consumer — that is, anyone purchasing as a private individual, without entering a valid VAT number — is entitled to a right of withdrawal, which may be exercised within 14 days of delivery of the products. Conversely, for those who purchase as a Company or Sole Proprietorship, entering a valid VAT number, the right of withdrawal is never granted.
To exercise it, the Consumer is invited to send a communication to the address info@automationparts.com, stating the following elements:
- Recipient: MotionTech s.r.l., VIA GUGLIELMO MELISURGO 15, 80133 NAPOLI – e-mail: info@automationparts.com;
- declaration of withdrawal from the contract of sale relating to the goods/services purchased;
- date of the order and date of receipt of the goods;
- first and last name of the Consumer;
- address of the Consumer;
- date of the communication.
Authorisation to return the products does not in any way imply acknowledgement of defects or non-conformity: any lack of conformity is in fact verified only after the goods have been returned, through inspection and technical analysis. Such verification takes from 1 to 7 working days from the arrival of the goods at the warehouses of Motiontech S.r.l.s. where the buyer is a Consumer, and from 1 to 15 days where the buyer does not hold that status.
For this reason, the Customer must handle the product only to the extent strictly necessary and must protect the original packaging with a further outer wrapping, so as to preserve its integrity during transport and to avoid affixing writing or labels directly onto it.
The products for which the Seller has authorised the return must be returned by the Customer via a carrier offering trackable shipment — and always insured where the value exceeds €500. A copy of the authorisation notice bearing the relevant "Return Code" must be enclosed with the shipment, to be sent to the address info@automationparts.com within 14 (fourteen) days of the reporting of the defect or non-conformity.
Should the checks reveal any tampering with the product, the Seller will not refund the amount paid by the buyer and will promptly notify the Customer accordingly.
CANCELLATION AND REFUNDS
Every order is subject to the actual availability of the products. The Site undergoes constant, automatic updating in order to align the Seller's real stock as closely as possible with that displayed online.
The quantities available at the time of the order are not visible on the Site. Since the simultaneous access of numerous users, the concurrent possibility of "offline" orders and the variability of quantities held by supplying companies all affect actual availability, the Seller cannot guarantee with certainty the allocation of the ordered goods.
On specific promotional products, the Seller reserves the right to accept the order by reducing its quantities, subject to prior notice and acceptance by the Customer; failing such acceptance, the order shall be deemed cancelled.
The Seller may cancel the order in the event of product unavailability. In such a case, it informs the Customer by e-mail that the contract has not been finalised, setting out the reasons. Before proceeding to a refund, the Seller alternatively proposes replacement with a similar product or another available solution (surplus rush service, product in a different condition): a solution that always requires the Customer's express acceptance. In the absence of acceptance of the replacement product, the amount already committed on the payment instrument is refunded, with notice by e-mail.
In any case of cancellation of the order by the Seller, whatever the reason, it is understood that the Seller cannot be held liable for any damages resulting from the cancellation.
The order may also be cancelled at the Customer's request, to be sent to the address info@automationparts.com — preferably in reply to the order confirmation e-mails — subject to the Seller's assessment and approval. Cancellation is free of charge only where the Seller has not yet begun preparing the order, a circumstance verifiable through the "my orders" section or through an e-mail notice of commencement of preparation. The refund of the price is made in accordance with the instructions provided by the Seller from time to time.
Where the cancellation conditions set out above do not apply, the Customer may still request cancellation, subject to confirmation by Motiontech S.r.l.s. and against payment of: (i) an administrative management fee; (ii) the purchase costs of back-order components; (iii) transport costs; (iv) customs charges; (v) collection and currency-exchange fees possibly already borne by Motiontech S.r.l.s. in relation to the cancelled order; in addition to a penalty equal to 40% of the value of the products covered by the request, plus a further reduction in value where the goods are returned in a condition different from that of sale. The total amount will be communicated to the Customer following the cancellation request.
Cancellation becomes effective upon the Customer's express confirmation of the costs communicated by Motiontech S.r.l.s.. In the absence of a reply within and no later than 72 (actual) hours, confirmation of cancellation shall be deemed tacitly given. Any cost for the return shipment of the cancelled order is borne by the Customer and must always be made by trackable shipment, insured where the value of the goods exceeds €500.
PRODUCTS DAMAGED IN TRANSIT
If a parcel containing products purchased from Automation Parts arrives damaged at the Customer's address, the Customer must refuse delivery by the courier. Should the Customer instead accept the parcel, they must: (i) note the damage on the courier's delivery document, so as to enable Automation Parts to file a claim; (ii) keep the products, the original box and the packaging material in the condition in which they were delivered; (iii) promptly notify Automation Parts by writing to customer service at info@automationparts.com, so as to arrange the courier's inspection.
Upon delivery, the Customer is required to check:
- that the number of packages received matches that stated in the transport document sent to them;
- that the packaging is intact, neither damaged nor otherwise altered, with the closing seals unbroken.
Any external damage or discrepancy in the number of packages must be contested immediately to the delivering courier, by affixing the wording "acceptance with reservation". In the specific case of a damaged parcel, the courier's waybill must bear the note: "acceptance with reservation as the parcel is damaged".
Once the courier's document has been signed, the Customer may no longer raise objections regarding the external characteristics of what has been received.
Should the Customer provide an incorrect shipping address, the order is delayed and additional shipping and handling charges are calculated for returned or re-addressed orders; in such a case no refund may be requested.
REFUND APPLICATION METHOD
Once approved, the refund is processed using the same payment method chosen at the time of purchase: credit card, PayPal or bank transfer.
New and refurbished products are covered by a Automation Parts warranty of 12 months from the delivery date; used products are instead guaranteed by Automation Parts for 6 months.
Customers qualifying as Consumers also benefit from the legal guarantee of conformity provided by the Consumer Code, lasting 24 months from the delivery date: in the event of a product not conforming to the order (for example received damaged or incorrect), the lack of conformity must be reported within 26 months of delivery.
To activate the warranty, simply contact our customer service at info@automationparts.com, or open a request from the dedicated section of the "My orders" personal area. Following a careful assessment by Automation Parts, we will proceed with the repair or replacement of the non-functioning or non-conforming product. A refund is envisaged only where neither of the two preceding remedies is feasible for the seller.

Warranty void
The warranty is voided in the event of: tampering, unauthorised removal, failure to follow the user instructions, use of a voltage other than the one prescribed, fitting of non-genuine parts or parts not complying with the technical specifications, faults due to improper use of the device, repair attempts by unqualified personnel, damage caused by natural and non-natural events (lightning, fire, flooding, vandalism and the like). The warranty conditions apply solely to the product affected by the malfunction, accompanied by the relevant return authorisation.
PAYMENT METHODS
Currency
You can pay in the main international currencies: at the time of collection, the amount is converted and credited in Euros. In other words, the payment leaves in your currency and we receive it in Euros at the prevailing exchange rate.
Please note that any costs of the international bank transfer (fees of the ordering bank, of intermediary banks and exchange charges) are entirely borne by you.

At the end of checkout you will see the order confirmation page, complete with IBAN and BIC (SWIFT) code. At the same time you will receive a confirmation e-mail with all the details needed to arrange the transfer. Please state the order number or the sales-invoice reference in the payment description. The order is processed as soon as we receive a copy of the payment at info@automationparts.com.
Only transfers via IBAN and the SEPA network are accepted.

We also offer one of the safest methods for instant payments: with PayPal, transactions are covered by purchase protection. Our address for PayPal payments is motiontech.acquisti@gmail.com. All the details needed to complete the payment are in any case included in the payment link, generated upon order confirmation and sent to the e-mail address stated on the proforma invoice.
PayPal supports the main international currencies; here too, the final credit is made in Euros.
Debit / credit cards
We accept most credit and debit cards, including Visa, MasterCard and American Express. To ensure maximum security we rely on the Stripe payment gateway: the payment is processed over an encrypted SSL connection, PCI-DSS compliant and protected by 3D Secure dual authentication, safeguarding and encrypting your data. If your payment is declined, carefully check the card number, expiry date and security code; if the details are correct, contact your bank's customer service to understand the reason for the decline and, where applicable, remove restrictions on international payments with your card.

The card-payment details are likewise included in the payment link, generated upon order confirmation and sent to the e-mail address provided at checkout. Our company does not store transaction data on its servers and does not receive sensitive card information from Stripe.
WE DELIVER WORLDWIDE
Automation Parts ships worldwide, relying primarily on DHL Express as its main courier; in particular cases, secondary couriers may be used. Thanks to dedicated agreements with carriers, we can guarantee fast and safe deliveries anywhere, with all shipments insured.
Note: for shipments outside the European Union, customs duties and taxes may apply. Companies must provide us with their business name, registered-office address and VAT identification number, all of which are essential for invoicing. In the event of storage at the carrier or issues during delivery, the related costs are borne by the customer.
For items not in stock, delivery times may vary according to the manufacturer's or supplier's lead times. Tracking information becomes available once the shipment leaves our warehouses; depending on the carrier, tracking may not be viewable until 24 hours after the goods have departed. Once your order has shipped, you will receive a confirmation e-mail with the tracking number. After entrusting the shipment to the courier, Automation Parts is no longer responsible for any delivery delays.
DELIVERY TIMES
The approximate delivery time for goods in "In Stock" status is usually 1 to 10 business days.
For "Available on Order" goods, times are subject to change depending on delays in production by the manufacturer or in processing by the supplier.
SHIPPING
Automation Parts delivers to the customer, at the address provided, the products selected and ordered in accordance with the procedures described in the previous paragraphs, through a courier and/or forwarding agent. Delivery takes place within the times specified in the order confirmation.
Upon receipt, the customer must check the conformity of the delivered products with the order and only thereafter sign the delivery documents, without prejudice to the right of withdrawal governed by the relevant "Right of withdrawal" clause. Automation Parts assumes no responsibility for any delay or failure to deliver the goods due to force majeure events, such as accidents, explosions, fires, strikes, earthquakes, floods and any other event that may prevent, in whole or in part, the performance of the contract within the established terms.
Automation Parts shall not be held liable, towards the customer or third parties, for damages, losses and costs arising from the failure to perform the contract for the reasons indicated above.
